Seat Belts and Motorcycle Helmets: The Hard Paternalism Society Accepted
Mandatory belts and helmets are a rare example of direct coercion for safety's sake that saved hundreds of thousands of lives and became a social norm.
Seat belts and helmets are a favourite argument of paternalism's advocates: direct interference in personal choice that prevents serious harm and, over time, comes to be accepted by almost everyone.
From resistance to norm
Mandatory seat belts initially provoked protest as an intrusion on the driver's freedom. But decades of campaigns and laws turned them into a norm: today an unbuckled belt is perceived not as an expression of freedom but as recklessness.
Seat belts: the numbers of lives saved
By NHTSA's estimate, in 2017 seat belts saved about 14,955 passenger-vehicle occupants in the United States; a buckled belt roughly halves the risk of death for front-seat occupants (NHTSA). At the same time, nearly half of those killed in passenger vehicles were unbuckled — the harm concentrates where the norm is ignored.
"Primary" versus "secondary" laws
The strictness of the rule directly affects the outcome: in states with "primary" laws (an unbuckled belt is itself sufficient grounds for a stop), belt-use rates exceed 92%, against about 83% where the law is "secondary" (NHTSA).
Motorcycle helmets: effectiveness and debates about freedom
Helmets are 37% effective in preventing the death of motorcycle riders and 41% for passengers, reducing the risk of head injury by about 69%; in 2017 they saved around 1,872 lives (NHTSA CrashStats). The CDC classifies universal helmet laws as a proven-effective measure (CDC).
Why society accepted this coercion
Unlike the "soda ban," mandates on belts and helmets passed through elected legislatures and decades of public campaigns. High and readily measurable harm, partly borne by society, plus a legitimate procedure — that is the formula for paternalism that takes root.
